Welcome to Rock & Art – Cultural Outreach! We are a platform dedicated to the promotion, discussion, and celebration of rock music, diverse art forms, and global cultural expression.

1. Description of Service

Rock & Art – Cultural Outreach provides a digital space that includes, but is not limited to, original articles, interviews, reviews, event calendars, artist profiles, photo galleries, video content, and community forums. Our mission is to foster a vibrant community passionate about art and culture.

2. User Eligibility and Accounts

  • Age Requirement: The Service is intended for users who are at least 13 years of age. If you are under the age of 18, you represent that you have your parent’s or guardian’s permission to use the Service and that they have read and agreed to these Terms on your behalf.
  • Account Registration: To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process. You are solely responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

3. User Conduct and Community Guidelines

We are committed to maintaining a respectful, inclusive, and constructive community. By using our Service, you agree not to:

  • Violate the intellectual property rights of others, including copyrights, trademarks, and patents.

We reserve the right, but not the obligation, to monitor and enforce these guidelines and to remove any content or suspend any user account that violates these Terms, at our sole discretion.

4. User-Generated Content (UGC)

You may be able to post, submit, or share content, such as comments, forum posts, images, or articles (“User-Generated Content” or “UGC”).

  • Your Ownership: You retain all ownership rights to the UGC you create and post.
  • License Grant to Us: By submitting UGC to the Service, you grant Rock & Art – Cultural Outreach a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your UGC in connection with the Service and our mission. This licence allows us to promote your content, feature it on our Site and social media channels, and archive it as part of our cultural record.
  • Your Responsibility: You are solely responsible for your UGC and the consequences of posting it. You represent and warrant that you have all necessary rights, licences, and permissions to grant the above licence to us and that your UGC does not infringe upon the rights of any third party.

5. Intellectual Property Rights

Excluding User-Generated Content, all materials within the Service, including but not limited to the Rock & Art – Cultural Outreach name and logo, text, graphics, articles, photographs, videos, and website design (the “Our Content”), are the property of Rock & Art – Cultural Outreach or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute Our Content without our express prior written permission.

6. Copyright Infringement Policy (DMCA Notice)

We respect the intellectual property of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our Service, please notify our copyright agent. Under global best practices and frameworks like the Digital Millennium Copyright Act (DMCA), your notice must include:

ROCK & ART – CULTURAL OUTREACH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; NOR DO WE MAKE ANY WARRANTY AS TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT AVAILABLE THROUGH THE SERVICE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROCK & ART – CULTURAL OUTREACH, ITS DIRECTORS, EMPLOYEES, OR VOLUNTEERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (III) UNAUTHORISED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

You agree to defend, indemnify, and hold harmless Rock & Art – Cultural Outreach and its affiliates, directors, officers, employees, and volunteers from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from your use of and access to the Service or your violation of any term of these Terms.

11. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. You may terminate your account at any time by contacting us or using the account deletion feature, if available.

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the competent courts located in the city of London, United Kingdom, and you hereby consent to the jurisdiction of such courts.

13. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
